INSURANCES

The following are Clauses from our standard ‘Building Contract’ relating to insurance provisions:

Safety of, and injury to, or death of persons

The Contractor shall take all necessary steps to ensure the safety of all site operatives, as well as the security of the Works, and allow entrance only to authorised persons.

The Contractor shall be liable for, and shall indemnify the Employer against, any expense, liability, loss, claim or proceeding arising in respect of personal injury to or death of any person arising out of or in the course of or caused by the carrying out of the Works.

Injury or damage to adjacent property (optional Clause, depending on location of the works)    

The Contractor shall be liable for, and shall indemnify the Employer against, any expense, liability, loss, claim or proceeding in respect of any injury or damage to any property real or personal (other than injury or damage to the Works) providing such injury or damage arises by reason of the carrying out of the Works and to the extent that the same is due to any negligence, omission or default of the Contractor or of any person employed or engaged by the Contractor on or in connection with the Works.

Insurance of the works

The Employer shall insure the Works against loss or damage by fire, lightning, explosion, storm, flood, earthquake and the bursting or over flowing of water tanks, apparatus or pipes.

If any such loss or damage occurs, then the Employer may, at his discretion, issue instructions for the reinstatement and making good of such loss or damage.
